General terms and conditions of business
           

  1. Scope of application These General Terms and Conditions (GTC) apply to all deliveries and services from Medes Group owner Michael Watzinger (hereinafter www.medes-group.com) to consumers. A consumer is any natural person who concludes a legal transaction for a purpose that can predominantly be attributed neither to his commercial nor to his independent professional activity. For all orders in my online shop, my copyright under point 10 authors comes to account.

  2. Contracting party 
    The purchase contract is concluded with Medes Group, owner Michael Watzinger, Wattenweiler, Dorfstraße 15, 86476 Neuburg an der Kammel

  3. Conclusion of contract

    1. The display of the images and the ordering of the service does not constitute a legally binding offer, but merely an invitation to order.

    2. Prices are binding and include the applicable VAT.

    3. By clicking the button on www.medes-group.com/shop , you are placing a binding order. Your purchase contract is concluded when we accept and confirm your order by sending an order confirmation or invoice by email or mail immediately after receiving your order.

    4. There is a right to acceptance.
       

  4. Right of withdrawal

    1. If you are a consumer (i.e. a natural person who places the order for a purpose that cannot be attributed to your commercial or independent professional activity), you have a right of withdrawal in accordance with the statutory provisions.

    2. If you, as a consumer, exercise your right of withdrawal in accordance with section 4.1, you will have to bear the regular costs of return.

    3. Otherwise, the provisions for the right of withdrawal are set out in detail in the following

      Right of withdrawal 
       
      You have the right to withdraw from this contract within fourteen days without giving any reason. 
       
      The cancellation period shall be fourteen days from the day on which you or a third party designated by you takes possession of the order confirmation. 
       
      To exercise your right of withdrawal, you must inform us [enter name of entrepreneur, address, telephone number and email address] by means of an unambiguous declaration (e.g. a letter sent by post or an email) of your decision to withdraw from this contract. You can use the attached model cancellation form for this purpose, but this is not mandatory. You can also electronically fill out and submit the model cancellation form or another unambiguous declaration on our website (insert internet address). If you make use of this option, we will send you a confirmation of receipt of such a cancellation immediately (e.g. by email). 
       
      To comply with the cancellation period, it is sufficient that you send the notification of your exercise of the right of cancellation before the expiry of the cancellation period. 
       
      Consequences of cancellation 
       
      If you cancel this contract, we will refund all payments we have received from you promptly and at the latest within fourteen days from the date on which we received notification of your cancellation of this contract. For this refund, we will use the same means of payment that you used for the original transaction, unless something else was expressly agreed with you; under no circumstances will you be charged any fees for this refund.

  5. Prices

    1. The prices stated on Medes Group www.medes-group.com website include statutory VAT and other price components.

    2. Prices are binding

    3. You can find current prices in the online shop.

    4. Currently valid payment methods are stated in the shop. Please note point 12.Payment.
       

  6. Drawings

    1. Each drawing is unique and available once in the online shop. The drawing is personally drawn by Michael Watzinger. It is offered in the online shop of Medes Group www.medes-group.com/shop or specified platforms.

    2. The price is binding and non-negotiable.

    3. Please also note the section Copyright from point 10.1

    4. Invoicing in the online shop takes place shortly after the order

    5. The shipping method is insured and specified during the order process. A tracking number will be provided.

    6. Drawings can be picked up but also delivered Drawings can be paid in the online shop or directly at handover. An invoice will be issued.

    7. The drawing  is packaged for shipping to avoid damage to the drawing.

    8. An exchange of the drawing  is excluded; a unique piece cannot be exchanged.

    9. The pictures in the online shop show the drawing  for sale.

    10. The point of color scheme in the article description is to be noted in the shop.

    12. Discounts and vouchers will be stated separately as described under point 13.Discounts and vouchers.

    2. The flyer is marked accordingly.

    3. All prices include the applicable VAT.

    4. Shipping costs and delivery quantity can be found in the article.

    5. A right of objection exists as in point 4. Right of objection indicated.

    6. Invoicing will take place promptly.

    7. For flyers, the payment options specified under point 12 apply. Payment

    8. Discounts and vouchers are provided separately as under point 13. Indicate discounts and coupons.

    9. Flyers will be sent immediately or can be picked up, but also delivered in the specified delivery group are the information in the ordering process.

    10. Custom-made products are not possible.

    11. The purchased flyer can be used.

    12. The source of authorship must be indicated.

    13. The invoice and the given name are decisive for the use.

    14. Reproduction without prior purchase is prohibited.

  11. Copyright

    1. All images, photos, drawings, logos, graphics, graphic artworks, monochrome artworks, other graphic art, videos, words and texts are subject to my copyright. This is based on current case law and penalties for infringements that violate applicable copyright law.

    2. Under German law, the Copyright Act (UrhG) applies, as detailed in  the Act on Copyright and Related Rights. You can read the complete UrhG here . Furthermore, European and international law, which protects my interests, applies.

    3. My legal department will pursue and report any violations. I will file lawsuits for injunctions to protect myself so that my media, my works of art, my unique pieces, cannot be reproduced and thus cause financial loss. I live in Germany but am not deterred by international lawsuits that enforce my rights as an author and graphic Artist.

    4. I then transfer to you, upon purchase in my online shop at www.medes-group.com/shop the applicable law and we will effectively invoice you upon successful payment of the equivalent amount. The invoice number, name and date are decisive for the use of the drawing, logos or artistic drawings or illustrations listed in the invoice. The information in the invoice is decisive.

    6. Unique pieces are unique and one-of-a-kind and this is what the Copyright Act and European and international law are intended to protect. This means that my Michael Watzinger works of art remain unique and one-of-a-kind in the whole world.
       

  12. Your Support 

    1. Your support is not a donation but rather a payment and is considered income for tax purposes.

    2. Sales tax is paid on the income and is considered for income tax purposes.

    3. A payment for Your Support can be made via the website www.medes-group.com.

    4. A receipt can be issued for the payment which contains the tax-relevant data. The sales tax is also listed.

    5. The payment is considered a service. The payment of your support/your support  represents a service, the service is without consideration and includes the website www.medes-group.com in particular the operation of the blog  and the website www.medes-group.com.

  13. Payment

    1. The invoice or receipt will be sent after the order has been processed in the online shop.

    2. Invoicing will be done promptly.

    3. The payment deadline is 14 days after receipt of the invoice by bank transfer or through payment points 12.8 and 12.9. The details and available payment methods in the online shop at www.medes-group.com/shop are decisive.

    4. When paying at handover, you pay the invoice amount directly or by invoice. Decisive is the order in the online shop of www.medes-group.com/shop.

    5. If the payment deadline is exceeded, reminder fees will be charged. The booking date is decisive.

  14. Discounts and vouchers

    1. Discounts and vouchers are indicated on Medes Group www.medes-group.com and are valid in the www.medes-group.com/shop online shop.

    2. Vouchers are available for a limited time in their category, type and duration.

    3. The validity must be observed.

    4. Only genuine and valid vouchers are valid in the online shop. Only valid vouchers and discounts are eligible for a reduction in the invoice amount. Counterfeits and attempted fraud will be prosecuted and reported in accordance with applicable law. 
       

  15. Retention of title

    1. The goods, drawings and digital media remain my property until full payment has been made.
       

  16. Dispute participation

The platform serves as a contact point for the out-of-court settlement of disputes concerning contractual obligations arising from online sales contracts. We are willing or obliged to participate in dispute resolution proceedings before a consumer arbitration board to resolve disputes with consumers (specify the legal norm or contractual agreement). To resolve the aforementioned disputes, we will participate in dispute resolution proceedings before this board.
